Hustlr — Terms of Service

Welcome to Hustlr! These Terms of Service ("Terms") govern your access to and use of the Hustlr platform, services, website, mobile apps, and related offerings (collectively, the "Platform"), operated by Hustlr, Inc. ("Hustlr," "we," "us," or "our").

By accessing or using Hustlr, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Overview

Hustlr connects customers ("Clients") with independent service providers ("Workers" or "Providers") for various services, including home improvement, cleaning, transportation, and more. Hustlr acts as a technology platform and facilitator, not an employer or direct service provider.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Hustlr. By using the Platform, you confirm that:

• You are legally authorized to work and/or contract in your jurisdiction.
• You will provide accurate information.
• You will comply with all applicable laws and regulations.

3. Account Registration

To access certain features, you must create a Hustlr account. You agree to:

• Provide accurate and up-to-date information;
• Keep your login credentials secure;
• Be responsible for all activity under your account.

Hustlr may suspend or terminate accounts for violation of these Terms or platform misuse.

4. Independent Contractors

Workers on Hustlr are independent contractors, not employees or agents of Hustlr. Workers are solely responsible for:

• The quality and completion of their work;
• Their own taxes, insurance, licenses, and legal compliance;
• Any risks or liabilities associated with the services they perform.

Hustlr does not supervise, direct, or control Workers' performance.

5. Payments & Fees

For Clients:

• You agree to pay the agreed-upon fee for any service you book.
• You authorize Hustlr to charge your payment method securely through our third-party payment processor.
• For bookings scheduled further in advance, a deposit (plus the service fee) may be charged to confirm the booking, with the remaining balance charged automatically to your saved payment method shortly before your appointment. The amounts and dates are shown at checkout before you confirm, and by reserving you authorize the later balance charge.

For Workers:

• You will receive payment after the job is marked complete or after the dispute window expires.
• Hustlr charges a platform fee on each transaction, disclosed in advance.
• Payments are subject to platform and processing policies.

6. Cancellations & Refunds

• Clients may cancel bookings subject to our Refund & Dispute Policy.
• Workers who fail to show up or cancel last minute may face penalties, suspension, or removal.
• Hustlr reserves the right to resolve disputes and issue refunds or partial credits at its sole discretion.

7. User Conduct

All users agree to:

• Treat others respectfully and lawfully;
• Not engage in fraud, harassment, discrimination, or illegal activities;
• Not solicit payments or services outside of Hustlr;
• Follow the Hustlr Code of Conduct.

Violations may result in warnings, suspensions, or permanent bans.

8. Background Checks

Hustlr may require Workers to complete identity verification and/or a background check, which may include a consumer report obtained from a consumer reporting agency. Any such check is authorized separately through Hustlr’s standalone Background Check Disclosure & Authorization — never by these Terms — and is conducted in accordance with the Fair Credit Reporting Act (FCRA) and other applicable law. No background check is run without your separate, explicit authorization.

9. Intellectual Property

All content on the Platform (except user-generated content) is the property of Hustlr or its licensors. You may not reproduce, distribute, or modify any part of the Platform without permission.

You retain ownership of content you upload but grant Hustlr a license to use it for operational and promotional purposes.

10. Disclaimers

• Hustlr provides a marketplace platform. We do not guarantee the quality, safety, legality, or suitability of any service.
• Use of the Platform is at your own risk.
• Hustlr disclaims all warranties, express or implied, to the maximum extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law:

• Hustlr is not liable for any indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount paid or received in the past six months related to your use of the Platform.

12. Indemnification

You agree to indemnify and hold harmless Hustlr and its affiliates, directors, employees, and agents from any claims, losses, or damages arising out of your use of the Platform, your services, or your breach of these Terms.

13. Termination

You may delete your account at any time. Hustlr reserves the right to suspend or terminate access for any reason, including violations of these Terms.

Upon termination, any pending obligations (such as payments or disputes) will still apply.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions.

Arbitration Clause:
Any dispute shall be resolved through binding arbitration under the rules of the American Arbitration Association. By using Hustlr, you waive the right to a trial by jury or to participate in a class action.

15. Changes to These Terms

We may update these Terms from time to time. We'll notify you of significant changes. Continued use of Hustlr after updates means you accept the revised Terms.
